As part of their response to the Ministry of Justice’s (MoJ) call for evidence on whether it would be fairer to have a dual or multiple discount rates, the Forum of Complex Injury Solicitors (FOCIS) is gathering investment management charges data from professional trustees and deputies.
It would be of great assistance to the course of ensuring the law remains fully adherent to the principal of full compensation and representing the interests of seriously injured claimants, if you are able to assist FOCIS with a survey and provide on an anonymised basis any supporting data that you can. The data is of particular importance, as this is a call for evidence rather than a consultation, but if you are unable to provide data it would still be helpful if you complete as many questions in the survey as you can.

The deadline set by MoJ is 11 April, but to enable FOCIS to analyse responses could they please be provided ASAP ahead of 31 March. Confidentiality will be maintained because the data provided should not include any identifiable client details and will be aggregated by FOCIS and hence also unattributable to any one professional adviser.
